Terms of Use

Welcome to QuackPort. By accessing or using the Service at quackport.com you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, registered users, and anyone who purchases from our store.

QuackPort is a rubber duck tracking platform. Users can log sightings of physical rubber ducks, view a duck's travel history, explore a global map of duck activity, earn points and achievements, and purchase custom rubber ducks through our store. Physical ducks sold through the Service include a unique serial code that links to a profile page on quackport.com.

You must be at least 13 years old to create an account or use the Service. By registering, you confirm that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian before using the Service.

You must verify your email address to activate your account. You are responsible for:

• Keeping your password secure and not sharing it with others.
• All activity that occurs under your account.
• Notifying us immediately at support@quackport.com if you suspect unauthorised access.

You may not create multiple accounts to evade a ban or other restriction. One account per person.

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You agree not to:

• Submit false, fabricated, or deliberately misleading duck sighting locations.
• Scan or log the same duck repeatedly in bad faith to accumulate points or inflate statistics.
• Upload or submit obscene, offensive, hateful, defamatory, or illegal content.
• Harass, threaten, or impersonate other users.
• Attempt to access, modify, or delete data belonging to another user.
• Use automated bots, scrapers, or scripts to interact with the Service without our written permission.
• Reverse-engineer, decompile, or tamper with any part of the Service.
• Use the Service to distribute spam, malware, or phishing content.
• Attempt to circumvent rate limits, security controls, or access restrictions.
• Claim ownership of a duck you do not physically possess.

By submitting photos, messages, or other content when logging a duck sighting ("User Content"), you grant QuackPort a non-exclusive, worldwide, royalty-free, perpetual licence to store, display, and distribute that content on the Service, including the duck's public history page and the global map.

You confirm that:

• You own the content or have the rights to submit it.
• The content does not infringe any third-party intellectual property, privacy, or other rights.
• The content complies with the Acceptable Use rules in Section 4.

We reserve the right to remove any User Content at our discretion, without notice, if we believe it violates these Terms or is otherwise harmful. Removal does not entitle you to any refund or compensation.

Duck sighting logs are kept even after account deletion to preserve the duck's travel history, but they are anonymized and no longer linked to your identity.

By placing an order you confirm you are authorised to use the payment method provided. Prices are listed in USD. We reserve the right to cancel orders due to pricing errors, stock issues, or suspected fraud.

Payments are processed by Stripe. We do not store your card details. By completing a purchase you also agree to Stripe's terms of service.

Shipping estimates are provided by our carrier partners and are not guaranteed. We are not responsible for delays caused by carriers, customs, or circumstances outside our control. Risk of loss passes to you once the order is handed to the carrier.

All sales are final. We do not accept returns or issue refunds except where an item arrives damaged or defective. If your order arrives damaged, contact us at support@quackport.com within 14 days of delivery with a photo of the damage and your order number. We will, at our discretion, offer a replacement or refund.

Physical duck orders include a unique activation code to claim your ducks on QuackPort. Activation codes are single-use. We are not responsible for codes that are lost, stolen, or shared. Keep your activation email safe.

Points and achievements are a fun, gamified feature of the Service. Points have no monetary value and cannot be transferred, sold, traded, or redeemed for cash. Points may be applied as discounts on QuackPort store purchases where eligible. We reserve the right to adjust, correct, suspend, or discontinue the points and achievements system at any time without notice or compensation.

Points earned through fraudulent activity (e.g., false sightings, ban evasion) will be forfeited and your account may be suspended or banned.

We reserve the right to suspend or permanently ban any account that violates these Terms, at our sole discretion and without prior notice. Banned users are blocked from re-registering with the same email address. If you believe your account was banned in error, contact us at support@quackport.com.

You may delete your own account at any time via your account settings. Deletion is immediate and irreversible. See our Privacy Policy for details on what happens to your data.

All content on the Service not submitted by users — including the QuackPort name, logo, design, software, and original text — is owned by or licensed to QuackPort and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or redistribute it without our written permission.

Maps are powered by OpenStreetMap contributors under the ODbL licence.

The Service displays advertisements provided by Google AdSense. Google may use cookies and similar technologies to show you personalised ads based on your browsing activity on this and other sites. You can opt out of personalised advertising at any time via Google Ad Settings.

We are not responsible for the content of advertisements displayed by Google. The appearance of an ad does not constitute an endorsement by QuackPort of the advertised product or service.

The Service may contain links to third-party websites or services (e.g., travel advisors, carriers). We are not responsible for the content, privacy practices, or terms of those third parties. Links are provided for convenience and do not constitute an endorsement.

QuackPort is not affiliated with, endorsed by, or associated with any cruise line, cruise company, or maritime operator. The cruise ship tracking feature is provided for informational and entertainment purposes only.

If you hide a rubber duck on a cruise ship or in any other venue, you are solely responsible for ensuring your actions comply with the policies of that cruise line, vessel, or location. Many cruise lines have rules about leaving unattended items — check with your cruise line before hiding a duck. Where no formal policy exists, we ask that you exercise good judgment and common courtesy:

• Hide ducks in safe, visible locations where they will not be mistaken for a security concern.
• Do not hide ducks in restricted areas, near safety equipment, or in ways that could cause disruption.
• Do not damage property or trespass in the process of hiding or finding a duck.
• Be respectful of staff and other guests.

QuackPort accepts no liability for any consequences arising from the hiding or finding of ducks in any location.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Duck location data is user-submitted and we make no representations as to its accuracy.

To the maximum extent permitted by applicable law, QuackPort and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

You agree to indemnify and hold harmless QuackPort and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction in the United States. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If we make material changes we will make reasonable efforts to notify you (e.g., via email or a notice on the site).
